Saga Ward-Gabriel: Another “small” victory for Jeremy Gabriel

The Court of Appeals holds that the prescription debate in the Gabriel-Ward case is necessary to determine whether Jeremy Gabriel’s mother has the right to sue the comedian, like her son, for damages.

The legal fight between Jeremy Gabriel and Mike Ward continues to plunge into a maze of proceedings.

Let’s remember first that Jeremy Gabriel was dismissed by the nation’s highest court, arguing that he used the wrong car, discrimination, to sue the comedian, when it was a libel case.

Jeremy Gabriel took the Supreme Court at its word and responded by suing for $288,000 in damages, with his mother also claiming $84,600.

However, Judge Manon Goudreau declined to prosecute the mother, considering that the deadlines had expired. The mother also sued Ward in the Human Rights Court, but that case was adjourned while Jeremy’s case was taken to Canada’s highest court, hence the argument for the limitation period in this case.

So a quick first argument was made in the Court of Appeals for an appeal dismissal of Ward’s attorneys, so that this argument on the statute of limitations would, they hoped, be quickly dismissed. However, three judges of the Court of Appeal decided otherwise.

Instead, they felt the need for a substantive discussion. “We are of the opinion that the appeal should be allowed,” they decided.

Me Harvey acknowledges that this is a “small victory,” but states that had the judges accepted this request, the entire file would have been over.

“The appeal deserves to be continued on the basis of the facts,” the lawyer explains. Accordingly, a second paragraph relating to the prescription will have to be performed in the coming weeks.

Meanwhile, Gabriel’s $288,000 lawsuit remained in court.

The story goes back 10 years, when comedian Mike Ward made a joke about “Little Jeremy,” a singer with Treacher Collins syndrome.
