Tim Hortons has pledged to give away free pastries and coffee to anyone who gets involved in a class action lawsuit against the restaurant chain alleging that its mobile app invades customer privacy.
Several Tim Hortons consumers were surprised to receive a statement from the company advising them of the agreement reached to drop the lawsuit.
“As part of the proposed settlement agreement, eligible App users will receive a free hot drink and pastry,” the statement read.
All Canadian App users with a registered account and whose geolocation information was collected between April 1, 2019 and September 30, 2020 are eligible for this Agreement.
The credit will allow you to get a pastry with a maximum value of $2.39 plus taxes and a hot drink with a maximum value of $6.19 before taxes.
The amount will be deposited directly on the mobile application of the respective customers or sent to the email address of the beneficiary. However, you will have to claim coffee and pastries within 12 months after depositing, at the risk of losing this privilege.
Remember that several privacy commissioners across Canada, including the Commission d’accès à l’information du Québec, have launched a joint investigation into the way the Tim Hortons app can collect data about the geographical location of its customers.
A consumer who used this app and Burger King has claimed damages since the app allegedly tracked his movements without his consent when it was closed.
Tim Hortons then denied the claim and thus agreed to a national settlement without admitting responsibility.
The settlement approval hearing will take place on September 6 in the Montreal court.
